I have a work related travel (2 days max) coming up in January. Do I need a canadian visa. I am on AP and my US visa on my passport has expired. My H1 is valid till 2009 (not stamped on the passport).
My question is Do I need a canadian visa? Let me know if anyone had a similar experience.

If you are from a country who is not exempt from a canadian visa (especially for work), you should definitely get one. your AP does not entitle to enter any other country other than the U.S.

H1b from non-cap to cap cannot be transfered. In order for you to work in private companies, you need to get new H1b by filing in on april 1 st 2009 which will ahve start date of oct 2009. Untill then you are stuck ..!!!
However you can transfer your present H1b to another non-profit h1b. I know the rules sucks..I ahve been in your place and got H1b this time. Can't wait to to get freedom on oct 1st.

Hi
I want to transfer my H1-b from a consultant company to a non-profilt organization which is offering me a full time job. I haven't resigned my job at consultant company yet. The LCA process is going on with new non-profilt organisation and then they are going to apply for H-1B petition soon. I am worried if the consultant company will cancel my visa as soon as I resign and that would cause issues for the H-1b transfer. Please advice when is it safe time to resign and start my new job.

You must have at least two years of post-baccalaureate experience in a high-tech field to be eligible for an H1-b visa, or else have a masters or higher degree. So where did you get your experience? Are you still back in your own country? Working? Or did you just get your bachelor's in the US and are still in the US,

Have we taken in to account these action items
1) Improve Overall GC Process time.
2) Re-use all unused visa's that went in vain in past
3) Count each family as one visa instead of each for each family member.
And What do we need to do as a member of IV to lobby these changes.

I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.

I was wondering about DOL letter which my employer received yesterday..for Recruitment process for 30 days..I wanted to know is it because of the conversion we did to RIR process some days back or is it just that they caught up with my TR application after 5 years..TR-Oct 2001

My last H1 transfer gave me a 3yr H1 approval. But in reality, this will make it 1 year more than the 6 years allowed. My Perm and 140 are approved before the 6th year ended and my company filed a H1B amendment request just a day before 6th year ended. It is still pending. Now, my wife is in india and she has to get back here for filing 485 in july. Can I use my existing H1 to apply for visa in this situation?

� My wife came here on L2 in Aug-2007 and then applied for EAD
� She has been working on EAD since Aug-2007 with Company A
� Company A applied for her GC on 18-Aug-2009 in EB2 while she was still on L2
� Company A applied for H1 which got approved on 08-Oct-2009 till 01-Oct-2012
� We travelled out of US on 10-Dec-2009 and only gave the L2 I-94 on departure, didn�t give H1 I-94
� She got her L2 stamped from India and entered US on L2 on 03-Jan-2010
Please let us know the following:

Anybody filed Un Signed Labor Substitution?
Since the cut off date was Jul 17th my attorney filed un signed Labor substitution with I-140.
Any experince any body has, I request you to share that here.
Chance of denial or rejection is very high if the Labor substitue application is not signed by the applicant.

I'd suggest contacting Adobe. Surely if you have a product that supports the file-format, and an upgrade of the firmware changes that, it's part of Adobe's support package to allow an upgrade of the Raw File support.

I have a question regarding my spouse who is on H4 visa.she has real experience in India for 5 years. One of the company who does some projects did H1b processing through "CONSULAR PROCESSING". Her H1B is approved now.
1) Employer is saying she has to go out of the country to get the visa in order to work.
2) Apply for change of Status while staying in USA. Employer saying that there are chances of getting an RFE during that process. Is there any Premium process in Change of Status processing.
which one is advisable?
Can any one please suggest.

Robert Creamer has an interesting analysis of how the ruling in Arizona could affect the Democrats' prospects in November. Many pundits are assuming that Republicans benefit. But Creamer makes a point I've said here many times. The only voters who switch their votes on the immigration issue are Hispanics. Anti-immigrants NEVER vote for the Democrats anyway. They almost always have a host of issues that they care about and in most cases the GOP is the better fit for those voters. So Democrats who try and pander to the Tea Party types are wasting their time.
