My visa H1-B nd h4 visa was expired on june 30 2010. I have got an job offer and they filed my H1-B petition after july 20 2010. I have submitted my I140 and mine & my wife I485 applications in EB1 category on Feb 22 2010. The gap between the H1b process is nearly 20 days period. The USCIS has approved my H1 but my wife's H4 was denied.
Here is my question. Whether they would have kept the I-94 for me. How can we proceed with H4 denial situation. Please give me some suggesion

I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.
I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...

On March 19, 2010, the USCIS announced revised filing instructions and addresses for applicants filing an I-131, the Application for Travel Document.
Beginning March 19, 2010 applicants will have to file their applications at the USCIS Vermont Service Center or at one of the USCIS Lockbox facilities.
If you file the I-131 at the wrong location, the USCIS Service Centers will forward it to the USCIS Lockbox facilities for 30 days, until Monday, April 19, 2010. After April 19, 2010, incorrectly filed applications will be returned to the applicant, with a note to send the application to the correct location.

Hi All,
I am applying my Labor on EB2 tomorrow (07/26/2007). Is there any glim chacne for me to get the approval before 08/14/2007? I am going through Atlanta. Please let me know how long is the average time to get the cetification from atlanta center. (One of my friend applied on 07/17/07 and got the LC on 07/23/07 from atlanta center).

You could take a look at Track it. It will give you an idea of Atlanta backlogs . You could have a very good chance at Chicago though . Your friend was one in a million lucky and you could be one too .

Hello everyone,
I have heard that if you cancel your first LC and apply for a Second one you can still use the advertisements and all from the first one if you fall withing that "6 month" period. My question is -
Is it 6 month from the first day that the advertisement was published or is it 6 month from the day your first LC was approved? :confused:
Experts please shed some light on this.

Hi,
I am currently a dependent E-1 on my wife's visa and currently have a valid EAD which will expire mid-2010.
We are about to file I-140 and I-485 and my question is, should I also file for a new EAD at the same time even if its still 8 months from expiry? I'm not sure what the difference is between an EAD under the E-1 visa, or an EAD when filing the I-485, or if it doesn't matter at all.
