For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. My friends wife applied for h1b and left for India on march 30th, while on H4, they got their h4 stamped april 5th, and still dont know about status of h1b application. The i94 number mentioned in the I129 is the old I94 which was surrendered at port of exit. When they reenter sometime in may, she will get new I94 , which will of course, be valid exactly as the I94 mentioned on I129.
1. Will there be any other problem in port of entry , as she will be entering on H4 stamping.
2. Will the h1b application get rejected or queried.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

My application reached on July 17th but still no receipts received. Called USCIS saying its already 90 days. They took my data and gave me a referal number and asked me to call back after 1 month again... :(
They dint even check whether my data is entered into the system or not.

You can get I-20 etc. But I think you will have to go to home country to get your F1 stamped. But better check with a lawyer.

I have a question regarding my spouse who is on H4 visa.she has real experience in India for 5 years. One of the company who does some projects did H1b processing through "CONSULAR PROCESSING". Her H1B is approved now.
1) Employer is saying she has to go out of the country to get the visa in order to work.
2) Apply for change of Status while staying in USA. Employer saying that there are chances of getting an RFE during that process. Is there any Premium process in Change of Status processing.
which one is advisable?
Can any one please suggest.

No more interim EAD at Infopass since Sept 2006.
If it's an emergency like loss of job offer etc. you can take a cover letter with your receipt notice to Infopass and they can fax it to the Service Center for expedited service. Alternatively you can fax it yourself.
The decision whether to expedite your case rests with the Service Center.
Also I would say hang on for a few days if possible. I got my EAD approval e-mail after 101 days since RD from NSC.

1. If we withdraw I485, can I apply for B1 visa later to come back for business? Or because we have applied for immigration visa, our B1 application will be denied?
2. If we change I485 to Consular Process, probably we can not apply for B1, right?

My lawyer submitted the ETA 9089 on Dec. 2007 , we've been checking the case # A-XXXXX-XXXXX and the only thing that shows is: PROCESSING...
Isnt supposed to be 30 days??
My situation is really bad because right now my driver license expired and I cant renew without an Immigration Case Number, but my process stil on DOL as "processing"
Any suggestion or Comments??

Currently I�m holding h1 and same time has AOS with my existing employer. I�m continuing my employment based on h1 and use Advance parole for travel purpose. My employer mentioned about not revoking I-140, even if I move to new employer. Since with new client, I�m transferring my H1 visa, I have 2 options with regard to my AOS portability
1) Either just transfers my h1 without porting AOS with new client. Continue with my AOS with old employer, since he won�t revoke my I-140 and provide support for future employment.
2) H1 transfer and Porting my AOS with new client and it does require my job and description mentioned in I-140 matches with current offer.
I would really appreciate, if you provide your valuable suggestion/recommendation. The best option to go ahead with.
