According to a FAQ on Murthy.com about the Yates memo, it is possible to switch jobs (using AC21) if 140 and 485 have both have been pending 180 days. Murthy doesn't advise this under normal circustances because if an RFE is received on the 140, then it is problematic if you've left the company.

I am currently working on EAD (thru 485), graduated in August 07, applying for H1B (first time) in April 08, my questions

1. Any effect on my AOS.

2. Can I start working without going ouf of the country once my H1B is approved on Oct 1st 2008.

2.Yes, you can since you are going to get a new i-94 with your H1 approval.

Dear forum members,

I have a question regarding transferring my H1b. My scenario is i am on my 7th year of my H1b and it is expiring on Oct 2007. My current employer will be filing an extension of 3 years based on my approved I-140 in the month of June 2007. If everything goes well i will get my three year extension(2007-2010) by Aug 2007.

Question is

1) If i get a new job opportunity after 3 year approval ( start date will be Oct 2007) can i transfer it to my new employer by aug or i have to wait till the start date of H1 approval?

2) When can i start working for the new company?

Any response will be appreciated.

If there is a anti immigration material in any website, instead of pointing a link to it, it is better to copy paste the content here. This way we can avoid HITs to the website. The reverse could be done for pro-immigrant news/articles etc where the link will help us to post comments on the news website directly.

Here is my story
July 2nd - Wife and I applied for 485\EAD\AP

The lawyer sent a single check(I know !!! I know !!!)
Our applications got separated.

Mine came back on Aug 30th and my wifes last week
We have now refiled
This time it has gone for "special handling"-bypassing the mail room

I haven't got the receipt yet

Anyone who had a similar experience or went via special handling for some other reason...
How long does it take to get the receipt nowadays ?
(I couldn't see any receipt update on USCIS- I guess most of the people are past that stage)

Will special-handling speed up my Receipt OR EAD OR AP?

Hello folks. I hope someone can help me out on this issue. I applied for my wife's EAD back in July 2007. The EAD was processed in two weeks and we received the card. However, my wife's middle initial was incorrect and we sent it back to USCIS with an explaination concerning the mistake. USCIS stated that it would take anywhere from 2 months to 6 months to process the correction. Last week I received a letter from USICS stating that I need to submit a completed I-90 form. A I-90 form is used to replace a green card. We just applied for our adjustment of status in 6/2007 and are not permanent residents at this point. Getting the EAD has become a nightmare for us. Do I try and write a letter back to USCIS stating that they are asking for the wrong form. I tried to call them but they said to respond to the letter sent. I'm stuck between a rock and a hard place. Any help/advice would be appreciated.
