Hello
I came to the U.S when i was 12 from germany on a vwp and have stayed here ever since i'm 21 years old now married to a U.S citizen, I have all the papers filled out ready to send to the USCIS for AOS thru marriage to a us citizen but our attorney has warned us that there has been recent denials in these types of cases Im very terrified and clueless i dont know if i should proceed and go for it or just wait and see if anything changes.
Please let me know if you or someone you know has gone thru this.
I live in Chicago.

My I - 140 was filed in TSC and approved and I-485 also sent to TSC

I guess you should be ok...they may ask for company details like how you will generate revenues...what is plan in next 2 years...etc...

Hi,
I am transfering my H1b to my friends company. And I have to bear all fees. As such my case is simple, no complications. I have good education credentials and 10+ years of exp. Got education evaluation also with me.
I just went thru USCIS site and it looks like to me that filing H1 transfer by myself (or by my friend) is a fair simple job.
Can anybody give me advice or have some experiece in filing H1 or transfer H1?

My friend has his I-485 filed and has got EAD/AP, but the priority date is so behind, that he has no chance of getting a green card before his marriage. So, as I understand he should be able to bring his wife on H4 (as long as he maintains H1). My question is: does he have to re-file for I-485 to include his wife and if so will the priority date remain the same as the first application?She needs to file her own I-485 but only when PD become current. She has the same PD as primary applicant.

I was trying to find out if one can transfer from b1/b2 visa category to H1- B visa within the valid period of stay(i.e before the expiry of the I-94).
Go out of the country and come back in H1 status, provided you have a valid H1-B. (Can go to Canada also). Otherwise, too many hassles. (non-immigrant vs immigrant intent)
